Реферат

Статья посвящена отдельным аспектам реализации норм Федерального закона от 24 июня 1999 г. N 120-ФЗ «Об основах системы профилактики безнадзорности и правонарушений несовершеннолетних». Одной из главных причин недостаточно эффективной работы данной системы, проявляющейся как в случаях несвоевременного реагирования на ситуации детского неблагополучия, так и при необоснованном вмешательстве специалистов в дела семьи, является отсутствие актуального для современного этапа развития российского общества и положения детей понятия «ситуация социально опасного положения». В результате проведенного исследования автор статьи предлагает новый подход к данному понятию как к юридическому
факту, являющемуся основанием применения мер криминологической безопасности.

Abstract

he article is devoted to certain aspects of the implementation of the provisions of the Federal Law of June 24, 1999 N 120-FL “On the Basics of the System for Preventing Child Neglect and Juvenile Delinquency”. According to the author of the article’s opinion, the lack of the concept of
“the condition of socially dangerous situation” that is relevant to the current stage of the development of the Russian society and the situation of children in the community is one of the main reasons of
insufficient efficiency of the above mentioned system, which is clearly manifested both in cases of untimely response to situations when child is having trouble, and in cases of unreasonable interference
of specialists in family affairs. As a result of the research, the author of the article proposes a new approach to this concept as a legal fact, which is the basis for implementing criminological security measures.
