Abstract

The significance and originality of the draft is determined by several factors: 1) necessity to codify the legislation regulating detective activities and to avoid “washing out” of its subject; 2) progressiveness of the document itself which improves coordination and cooperation of detective bodies (some sides of the authors’ approach relating to fixing the relevant mechanisms are criticized); 3) model of detective activities’ principles; 4) innovative idea of social and legal protection of persons, assisting the detective divisions, through concluding employment contracts with them. The institution of compulsory measures of ensuring the detective proceedings (conveying; detention; personal search; seizure; destroying or making documents, objects, materials, substances worthless; restriction of using communication nets and facilities; communication service suspending) is highly assessed. The new wording of the norm stipulating the release of persons, fulfilling special crime fighting tasks, from criminal responsibility and other ideas (notably establishing the detective proceedings’ order, forming of detective glossary, developing the procedure of preparing and conducting detective actions) are approved. The considered Federal law draft requires conducting active work aiming at both adjusting normative acts, regulating the activities of detective bodies, in accordance with this law and amending the criminal, criminal procedure and labour legislation as well as subordinate normative acts of the Russian Federation. The proposed codification initiates new stage of the detective legislation’s development and favours the establishment of efficient legal regime of detective activities, protection of persons involved in the detective sphere and consolidation of legal mechanisms of ensuring individual rights when conducting detective actions.
