Abstract

The manifestations of the principle of unavoidability of legal liability are studied. It’s stated that great attention in legal literature is paid to traditional aspects of unavoidability as a reaction of authorized bodies to an offence. But such understanding of unavoidability of legal liability corresponds to its retrospective (negative) understanding and does notagree with the concept of positive legal liability and legal liability as a holistic legal phenomenon. The author considers that unavoidability begins with establishing obligations, imposing prohibitions and sanctions of legal norms. This aspect of unavoidability is realized in lawful behaviour of the subjects of legal liability.Other aspect of unavoidability of legal liability becomes effective only in the case of breaking the obligations, inobservance of the prohibitions and misuse of right. The author disputes with the scientists who deny the existence of the principle of unavoidability of legal liability referring to the existence of the institute of releasing from legal liability. The essence is not in the absence of this aspect, but in the features of its manifestation in social relations. The problem of legal liability functions and their correlation with the legal liability principles is analyzed. The effective legislation and practice of its application is examined; some proposals aimed at improving the effective legislation are given. The author’s definition of the principle of unavoidability of legal liability is provided. It’s argued that any offence should entail the reaction of authorized bodies, and punishment or application of legal liability measures has optional character.
