Abstract |
The beginning of the 21st century marks the search for the ways of optimization of crime detection and crime investigation procedures. To solve this problem the legislators of such CIS countries as Ukraine, Kazakhstan and Kyrgyzstan have integrated the detective activities into their Criminal Procedure Codes fixing the investigator’s right to conduct undercover investigative actions. The concept of undercover investigative actions used in the above-mentioned countries is considered. The classification of such actions is provided. The author proves the necessity to reconsider modern domestic legal doctrines in respect of the integration of detective and criminal procedural activities, and to fix the investigator’s powers to conduct undercover investigative actions, which will favour the efficiency of crime investigation. It is noted that investigators of our country have already begun to conduct undercover criminal proceedings. The essence of undercover investigative actions and their classification are considered. The author does not depreciate the importance of publicity in the investigator’s activities, but advises not to exaggerate it to the detriment of undercover activities. Undercover investigative actions are divided by the author into absolutely undercover, relatively undercover and confidential. Absolutely undercover actions imply arresting post-telegraph messages, their examination and seizure; receiving information on connections between subscribers or subscribers’ devices; conversations recording and control. The relatively undercover actions imply search, seizure and providing cover for the fact of suspect’s apprehension. The confidential actions imply prejudicial agreement on cooperation and measures of ensuring security of the criminal proceedings’ participants. |
