Abstract |
The issues of control and supervision mechanism’s functioning at the pre-trial stages of criminal proceeding are considered. Comparative analysis of mechanisms of judicial control, prosecutor’s supervision and departmental control, exercised by the investigative body’s head, is conducted. Advantages and disadvantages of these procedures in the light of law enforcement practice are noted. Judicial and extrajudicial types of complaints are analyzed. The right to bring a complaint to competent authorities is considered as an element of subject’s protection of his/her rights and legitimate interests in the criminal proceedings’ sphere, including its pre-trial stages. The issues, associated with choosing the subject of complaints’ resolving by criminal proceedings participants and persons, involved in criminal procedural relations, are studied. The author proves the necessity to eliminate departmental control (conducted by the investigative body’s head) and to empower prosecution bodies to resolve extrajudicial complaints. Existing organization of prosecutor’s supervision and preliminary investigation (when the prosecutor’s role is depreciated unlike the role of investigative body’s head) is criticized. It’s stated that only prosecutor (not the head of investigative body) should be empowered to resolve complaints. The powers of court and prosecutor should be accurately differentiated. Measures to improve the efficiency of extrajudicial complaints’ resolving (organizational and technical, criminal procedural and criminal legal measures) are argued. The doctrine model of criminal procedural evidence law of the Russian Federation, developed by the Nizhny Novgorod processualists, is considered. The connection between the author’s proposals and model’s conception of pre-trial criminal proceedings and the institution of co-investigating judges is noted. |
