Abstract

Despite the fact that the Constitution of the Russian Federation was adopted25 years ago, the provision concerning the direct action of its norms is not always implemented by the officials and bodies conducting criminal proceedings. The author of the article notes that the mechanism
for exercising the right to protection of a person whose legitimate interests can be significantly affectedby the actions carried out to verify the reported crime is not defined by the legislation. It also applies to
reporting a confession. The legal regime of inspecting the dwelling in which the crime was committed, in case the persons living in it are absent, creates obstacles to law enforcement activities. The author
comes to the conclusion that despite the development of certain provisions of the Constitution of the Russian Federation, the legislation, as well as the decisions of the Supreme Court of the Russian
Federation and the Constitutional Court of the Russian Federation do not contain a comprehensive mechanism to ensure the constitutional rights and freedoms of the individual. This results in their
restriction. Due to these circumstances, it is stated that the provisions of the Constitution of the Russian Federation do not always have direct effect in criminal proceedings.
