Abstract

Basing on the analysis of the theory of criminal law and materials of judicial practice, the authors of the article formulate the conclusion that the act of the subject of crime, committed together with the disabled person, is a subject to qualification according to the elements
of a gang crime. It is substantiated that such elements as a group of persons and a group of persons by prior agreement, contained in the Special Part of the Criminal Law, are not limited to the framework
of the institution of complicity and can be considered as elements of the objective side of the crime, characterizing the group method of committing a crime (socially dangerous act). It is argued that the
rule on the qualification of a crime involving the persons incapable to bear criminal liability should apply only to encroachments on life, health, freedom, including sexual inviolability or personal freedom by the
elements of a gang crime. Special attention is paid to the issues related to the qualification of socially dangerous acts committed by groups of insane persons. The authors formulate the proposals for
making amendments to the decisions of the Plenum of the Supreme Court of the Russian Federation regarding the regulation of the issue of legal assessment of a socially dangerous act committed by a
person who is the subject of crime, together with a person who is not the subject of crime.
