Abstract

The initiation of criminal cases involving private prosecution starts by the request of the victim or his legal representative. However, if the crime was committed against a person who, due
to his dependent or helpless state or for other reasons cannot protect his rights and legitimate interests, the criminal case is initiated by the head of the investigative body, the investigator, or the interrogating
officer (with the consent of the prosecutor). The analysis of the current legislation, law enforcement practice and scientists’ points of view showed that the uncertainty of the current wording of Part 4 of
Article 20 of the Criminal Procedure Code of the Russian Federation negatively affects the timeliness ofresponse and taking legitimate and reasoned decisions on private prosecution cases. In this regard, the
author of the article distinguishes the objective and subjective criteria of a dependent or helpless state or other reasons for which the victim cannot protect his rights and legitimate interests. It is proposed to
define helpless state of a victim in cases involving private prosecution as the mental and (or) physical state of the victim, by virtue of which he cannot actively protect his rights and legitimate interests
during the time required for it
