Abstract

When receiving a report on the disappearance of a citizen, first of all, police officers analyze the versions according to which the person’s disappearance is not related to criminality.Only after finding out that these versions are not confirmed, law enforcement agencies start to
consider the version that the crime against the missing person was committed, and that has negative consequences. The authors of the article believe that the absence of a federal law regulating the
actions of law enforcement agencies when receiving a report about the disappearance of a citizen is a gap in legislation. At the same time, the current instruction on the procedure for considering the
statements, crimes reported to the police and other information on incidents connected with the disappearance of persons is positively estimated. The authors of the article formulated the proposals
to improve the Federal Law “On crime detection activity”. The proposals relate to the crime detection action “interception of information from technical communication channels” and the investigative action “obtaining information about connections between subscribers and (or) subscribers’ devices”. As a part
of the investigation to obtain information about the connections of the missing person, it is proposed to abandon the judicial control over obtaining information about the connections between subscribers
and (or) subscribers’ devices.
