Abstract
|
The article deals with the problem of determining the legal norm under which it is necessary to bring to administrative responsibility the persons who have committed administrative violations that encroach on public order and public security and who have signs of intoxication, for refusing to undergo medical examination for the state of being intoxicated in accordance with Article 27.12.1 of the
code of Administrative offences of the Russian Federation. It is noted that the science of administrative law does not have the unified position to resolve this problem. The analysis of law enforcement practice
shows that the refusal of the offenders to comply with the lawful demands of police officers to undergo medical examination for the state of being intoxicated is qualified in different ways: 1) as disobeying the
lawful order or demand of a police officer in connection with the performance of his (her) duties to protect public order and ensure public safety, as well as obstructing the performance of his (her) official
duties, expressed in refusal to undergo a medical examination for the state of intoxication (Part 1 of Article 19.3 of the code of Administrative offences of the Russian Federation); 2) as an intentional failure
to comply with the lawful demands of the official conducting the administrative proceedings (Article 17.7 of the code of Administrative offences of the Russian Federation). According to the author’s opinion, the current situation needs the improvement of administrative legislation.
