Abstract

 In criminal proceedings, using the interpreter’s assistance for free is the constitutional right of a suspect (accused), who does not know or does not know enough the language of the proceedings. however, according to the results of the conducted research, this right is increasingly used by the defense party as a tool to counter the investigation of crime. At the same time, in many of the cases considered, the suspect (accused) perfectly knows the language in which the criminal proceedings are conducted. This circumstance significantly complicates the solution of the problems of justice within a reasonable time, and, сonsequently, the protection of the rights and freedoms of other participants in criminal proceedings. In this regard, the author of the article analyzes the procedure for ensuring the right of the suspect (accused) to use the assistance of an interpreter in case of various investigative situations, including the conflict ones, in which the circumstances of the abuse of such right are established. The algorithm of actions of the employee carrying out the criminal proceedings to prevent the suspect from abusing the relevant right is proposed. This algorithm can be used in different investigative situations and it can also be the basis for developing forensic recommendations.
