Abstract

The article gives a general description of the concept of disciplinary and legal coercion, as well as the opinions on its structure available in the legal literature. Basing on the principle of branch analogy, the allocation of measures of ensuring disciplinary proceedings as a separate group of means of disciplinary coercion is substantiated. The author suggests that the system of measures of disciplinary coercion includes the measures of disciplinary coercion, measures of disciplinary restraint, measures of ensuring disciplinary proceedings and disciplinary sanctions. The measures of mental impact, organizational measures and measures of direct coercion are singled out in the system of measures of disciplinary coercion. Turning to the measures of ensuring disciplinary proceedings provided by the legislation, the author determines their system, which includes: delivery; detention; personal inspection, inspection of things, vehicle inspection; seizure of things and documents; temporary suspension from the performance of official and (or) special duties; suspension from driving; medical examination. Further, the characteristics of the measures of disciplinary and legal coercion available in the existing administrative and disciplinary legislation of the Russian Federation are given, their goals and grounds are described, the procedure for their application is analyzed. Proposals for improving the legal regulation of administrative procedural and disciplinary legislation are made.
