Abstract

The article is devoted to the analysis of the nature of criminal motivation. The author presents his assumptions regarding the motivation of criminal behavior and the use of this knowledge when assessing the personality of the offender in relation to the purposes of criminal punishment. Basing on the fact that the knowledge and explanation of the behavioral motivation of the persons who had committed crimes is necessary for carrying out the crime detection activities, investigative actions, qualification of the act, individualization of punishment, prevention of possible crimes, the author of the article analyzes the processes leading to criminal behavior, the causes of which can largely be attributed to the sphere of unconscious mental activity. The need to depart from the traditional methods of determining the motives of crimes and not be limited by their description within the framework of the list contained in the criminal law is emphasized. The relevance of studying the multifactorial conditioning of a separate individual criminal behavioris substantiated. An attempt to use the comprehensive approach when analyzing the motivation of crime, from the standpoint of the interaction of conscious and unconscious, rational and emotional components, is made. The development of preventive measures and the choice of effective means of influencing the individual in order to prevent illegal behaviorare based exactly on the knowledge of the motivational patterns of criminal behavior.
