Abstract |
The composition of the subjects of criminal pre-trial proceedings is maximally focused on achieving the goals of the criminal procedure – protecting the rights and legitimate interests of the individuals and organizations affected by crime, as well as protecting the individual from illegal and unwarranted accusation, conviction and restriction of his or her rights and freedoms. The authors of the article investigate the prerequisites and the general scheme for optimizing the subject composition of criminal pre-trial proceedings, as well as the problems connected with the legal status of its key participants. In this regard, the following topical issues are considered: the problem of the investigator’s procedural status; the legal nature of the relationship between the preliminary investigation body and the prosecutor, the departmental procedural head; peculiarities of the protection of the persons affected by crime and possible reform of this institution using the legislative experience of the Republic of Kazakhstan; the internal contradiction in Article 86 of the criminal Procedure code of the Russian Federation and the role of the defending counsel in the process of collecting evidence. The relevance of the material presented in the article is connected not only with the close attention of the state to strengthening the guarantees of the rights of the individual involved in the criminal process, but also with the further development of its adversarial principles, which are increasingly penetrating the pre-trial proceedings. |
