Abstract

 The author of the article examines the legal nature of the institution of the recovery of procedural costs. legal norms regulating the public relations arising during the calculation and distribution of procedural costs with the aim to establish legal criteria, allowing to isolate them into a separate legal institution of the branch of criminal procedure law, are analyzed. however, it is impossible to consider this institution as a perfect one due to the uncertainty concerning the regulation of applying the provisions of articles 131 and 132 of the criminal Procedure code of the Russian Federation in the issues of recovering procedural costs by the preliminary investigation bodies and the courts, as well as the inconsistency of certain provisions. This leads to complex situations in practical activities, violations of the rights of participants in criminal proceedings, and sometimes to judicial errors. The relevance of this institution is due to the fact that all unnecessary expenses arising in the course of criminal proceedings before sentencing are imposed on the state. In the conditions of the necessity to save budgetary expenses, the issues connected with recovering procedural costs are of particular importance, because they are connected with certain manifestations of procedural economy in criminal proceedings. Therefore, recovering procedural costs from the convicted person is reasonable and rational.
